Thanks, Reds. That last post made more sense to me. I went ahead and contacted NGM as well as that Ebay seller. 
I do still have one question though; you said:

However, how are they being shorted if they can't even receive royalties anymore [b/c the CD isn't even being sold anymore]?? I mean, if I bought the CD from someone here on Tasty or on Ebay, Hydro would not receive royalties either. The fact is, there currently is NO possible way to get this music in such a way that gives Hydro royalties.  That being the case... it seems like it would be impossible to "short" them anything. 

Well, I'll let you know what I find out.  I'm gonna go e-mail Andy & Robbie now...

But in the meantime I had another question for you, Reds. You said:

At first this made sense to me, but I've been thinking more about it and still don't understand how it's not equally wrong.  I mean, think of it this way, if I steal a hundred cars and decide to give 'em to all my friends on Tastyfresh, and everyone knows I stole those cars... wouldn't you be just as guilty for having knowingly accepted a hot car [even as a gift]? 
Is it not the same with this guy & VNES. Sure, he might have committed the initial crime, but you are just as guilty if you are making use of what he has done wrong.  Just as much as if you accepted a car that you know was stolen. 
Of course, maybe that's what you meant by "you can still argue that it's wrong for us to play them". smiley25 Probably so & I'm just dense.  Oh well, I just would like to have a better understanding of copyright laws. It's so confusing to me.

I specifically put that b/c you are probably right. I know the goods are stolen and I'm enjoying. So yeah... I'm going to delete that thread now. I screwed up.

Look. If Andy says he's ok with it... then I'm fine. It's material HE worked on so only HE can give permission. This case is a bit odd b/c N*Soul would normally have that power, but since they are selling cdrs and their contract expired... I'll go with Andy.

He doesn't say he's ok with it. He says it's down to the person who wants to get te music. That can still mean it's illegal. Maybe he suggests that you can do it illegal, but that really you should try to get the original...

It's basically permission. I know how hard it is to find that cd. I'd want ppl to buy it if possible, but he won't get a dime buying a used one from ebay. Second-hand music sales don't go to artists or labels. It's part of the copyright laws here in the US.
